Anderson Auction Group – Terms and Conditions

  1. Definitions
    • “Auctioneer” refers to Anderson Auction Group, the entity conducting the auction.
    • “Bidder” refers to any registered individual or entity placing a bid in the auction, either online or in person.
    • “Purchaser” refers to the highest accepted and declared bidder who successfully purchases an Auction Item.
    • “Seller” refers to the party or entity offering Auction Items for sale.
    • “Auction Items” refer to the goods, personal property, or real property being auctioned.
    • “Absolute Auction” means an auction in which the item is sold to the highest bidder without reserve.
    • “Reserved Auction” means an auction where the Auctioneer or Seller may reject bids not meeting the reserve price.
  2. Agreement to Terms
    • By registering as a Bidder or Purchaser, each participant acknowledges, affirms, and agrees to be bound by and comply with the terms and conditions set forth in this Agreement. These Terms and Conditions apply to all auctions conducted by Anderson Auction Group, including live, simulcast, or timed online auctions.
  3. Eligibility
    • Participation is restricted to individuals aged 18 or older with the legal capacity to enter into contracts.
    • The Auctioneer reserves the right to refuse or revoke bidding privileges at its sole discretion.
  4. Auction Announcements & Modifications
    • The Auctioneer reserves the right to modify, cancel, or reschedule any auction at its sole discretion.
    • Any announcements made by the Auctioneer during the auction supersede any previously published terms and conditions.
    • The Auctioneer is not responsible for any damages or claims resulting from auction modifications.
  5. Auction Types & Bidding Process
    • Auctions may be Absolute (highest bid wins) or Reserved (subject to seller approval). The auction type will be disclosed on the listing page.
    • The Auctioneer reserves the right to determine bid increments, extend bidding, cancel or reschedule auctions at its discretion.
    • Tie Bids: In the case of a tie bid between an on-site and online bidder, preference will be given to the on-site bidder. The Auctioneer has full discretion to reopen the bidding in the case of a tie.
    • The Auctioneer has full discretion in resolving bid disputes.
    • Absentee (pre-bidding) and proxy bidding are allowed and managed through the online platform.
    • Bid increments will be at the auctioneer’s discretion, and in certain auctions, they may be specified in the auction listing.
    • For large purchases, a deposit or proof of funds may be required and will be specified in the auction listing.
    • Online-only timed auctions may have bid extensions if a bid is placed in the final seconds.
    • In case of technical issues during online bidding, Bidders must contact the designated online bidding platform for assistance. The Auctioneer is not responsible for system crashes, bid submission failures, or internet connectivity issues.
  6. Buyer Registration & Bidder Responsibilities
    • All bidders must register and provide valid identification before placing bids.
    • The Auctioneer reserves the right to request credit card verification or a refundable deposit before bidding.
    • Bidders representing a corporation must provide a Power of Attorney or legal authorization before bidding.
    • Providing false or misleading registration information will result in immediate disqualification.
  7. Buyer’s Premium Breakdown
    • A Buyer’s Premium will be added to the final hammer price.
    • The Buyer’s Premium may differ for onsite bidders vs. online bidders and will be specified in the auction listing.
    • The Buyer’s Premium does not cover applicable taxes, shipping, or transfer fees.
  8. Sales Tax & Resale Exemption Forms
    • Sales tax will be charged unless a valid resale certificate or agricultural exemption form is submitted before bidding.
    • Buyers must submit the required tax exemption documentation prior to bidding to avoid being charged sales tax.
    • If a buyer fails to provide proper documentation before bidding, no tax refunds will be issued after the auction.
  9. Payment Terms & Enforcement
    • Payment is due in full immediately upon an item being declared “Sold.”
    • Accepted payment methods: Cash, wire transfer, certified check, money order, debit card, credit card (3.79% convenience fee applies).
    • Invoices must be paid within 24 hours. Failure to pay by the deadline will result in:
      • 10% late fee and 18% monthly interest fee.
      • The Auctioneer’s right to declare items a “No Sale” and impose a 25% restocking fee.
      • Responsibility for collection costs, including legal fees.
      • The Auctioneer may pursue legal action, ban the bidder from future auctions, and report non-paying bidders to collection agencies or credit bureaus.
    • Chargebacks are strictly prohibited. Any initiated chargeback will be considered a breach of this Agreement and may result in legal action.
    • The Auctioneer does not offer in-house payment plans. Any financing must be secured prior to winning the bid and cannot be arranged post-sale. Third-party financing is permitted only if pre-approved before bidding.
  10. Force Majeure – Event Cancellation Clause
    • The Auctioneer shall not be held liable for auction cancellations or delays due to force majeure events, including but not limited to:
      • Natural disasters (hurricanes, tornadoes, earthquakes, floods, etc.).
      • Acts of war, terrorism, or government-imposed restrictions.
      • Power outages, cyberattacks, or online platform failures.
      • Any unforeseen circumstances beyond the Auctioneer’s control.
    • If an auction is canceled due to a force majeure event, the Auctioneer reserves the right to reschedule or cancel the sale without liability.
  11. No Warranty – All Sales Final
    • All items are sold AS-IS, WHERE-IS, with no guarantees or warranties of any kind.
    • The Auctioneer and Seller make no representations regarding condition, functionality, or suitability for a specific purpose.
    • Buyers assume all risks regarding the quality, age, or condition of purchased items.
    • No refunds, exchanges, or post-sale claims will be honored.
  12. Removal, Storage & Loadout Policies
    • Items must be picked up immediately following the auction or within the designated removal period.
    • Storage fees will vary based on item size, movability, and urgency and will be specified per auction.
    • Buyers may hire third-party pickup agents, provided they present proper documentation.
    • Final removal deadlines and abandonment policies will be auction-specific and detailed in the auction listing.
    • Auctioneer is not responsible for loading, rigging, or transportation of items.
    • Buyers must bring their own equipment, tools, and labor for item removal.
